By downloading, installing or using Dataly, you agree to these terms. If you do not agree, do not use the app or this website. If you use Dataly on behalf of an organisation, you confirm you are authorised to accept these terms for it.

Dataly measures how much internet data your device uses and presents it as current, daily, monthly and historical figures. It can pair with other devices you own on the same local network so those devices can display each other's daily download and upload totals. Dataly is an informational tool. It is not a billing system and is not affiliated with your internet or mobile provider.

You must be old enough to form a binding contract in your country, and at least 13, to use Dataly. If you are under the age of majority where you live, you may use Dataly only with the involvement of a parent or guardian.

You agree not to:

• use Dataly to monitor a device you do not own or are not authorised to monitor;
• reverse engineer, decompile or tamper with the app except where that restriction is prohibited by law;
• interfere with the pairing or sync mechanism, or attempt to connect to devices that have not paired with you;
• use Dataly to break the law or to infringe anyone's rights.

You are responsible for the devices you pair and for keeping your device secure. Only pair devices you control. Removing a device from your trusted list ends the pairing from your side.

Pairing requires physical or network access to both devices and a one-time code. Paired devices exchange only their own aggregate usage totals and the identifiers needed to recognise the pairing, as described in the Privacy Policy. We do not guarantee that pairing or sync will work on every network, router or operating-system version.

Dataly's figures are estimates. They are derived from operating-system counters and may differ from the numbers your carrier or internet provider reports, because of differences in what each side counts, when counters reset, background activity, and rounding. Do not rely on Dataly as the definitive record of your usage for billing, disputes or any decision with financial consequences. Always check your provider's own figures for that.

The mobile apps show ads to remain free. Some paid plans remove them.

Dataly Plus and Dataly Platinum are optional subscriptions, sold monthly or yearly through Google Play or the App Store at the price shown before you buy. Payment is taken by the store when you confirm. A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends; you can cancel any time in Google Play or your Apple account settings, and you keep your features until the end of the period you paid for. Refunds are handled by the store under its policies. The features included in each plan are listed in the app and may change over time.

Where available (currently Nigeria), you can earn free mobile data by watching rewarded ads, keeping a daily streak and inviting friends, and redeem it to a supported network once you reach the minimum shown in the app. Rewards have no cash value and can't be transferred or sold.

• An invite earns a reward only when the person invited is new to Dataly, keeps the app for at least a day and completes a rewarded ad. Invite rewards are limited each week.
• Inviting yourself, using several accounts or phones, or any other attempt to game rewards isn't allowed. We may hold or cancel rewards, and close accounts, where we see this.
• Amounts, limits and the rewards program itself may change or end.

Dataly, its name, logo, interface and content are owned by OneWave and its licensors and are protected by intellectual-property law. These terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for personal, non-commercial purposes. All rights not expressly granted are reserved.

We may update, change or discontinue Dataly, any feature, or this website at any time. We may also release updates that you need to install for the app to keep working. We are not liable to you for changing or discontinuing the service.

Dataly is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that Dataly will be uninterrupted, error-free, or accurate.

To the fullest extent permitted by law, OneWave will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising out of your use of or inability to use Dataly. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

You may stop using Dataly at any time by uninstalling it. We may suspend or end your access if you breach these terms or use Dataly in a way that could harm other users or us. Terms that by their nature should survive termination will survive.

We may revise these terms from time to time. We will update the effective date above, and for material changes we will provide notice in the app or on this page. Continuing to use Dataly after changes take effect means you accept the revised terms.

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, and the courts of the State of Delaware, United States will have jurisdiction, except where applicable law gives you the right to bring proceedings in your own country of residence. The formal contracting entity is OneWave.
